Uncontested Divorce

When a divorce is uncontested, it generally indicates both sides have agreed to end the marriage. However, this does not always mean that all of the related issues have been resolved. Though both sides may be consent to the divorce, they may have differing opinions on how child custody, child support, alimony and property division should be handled.

Collaborative Law vs. Litigation

Through the collaborative law process, both sides in a divorce work together in an atmosphere of co-operation, integrity, honesty and professionalism that focuses on the future well-being of the family to resolve the issues that accompany a divorce, including alimony, child support and property division. Litigation is an adversarial process that takes place in court. This can be a time-consuming and costly process, but may be the best option for individuals who cannot agree on terms of a divorce and wish to fight for their rights.

Divorce vs. Legal Separation

In some cases, it may be beneficial for clients to obtain a legal separation instead of a divorce. A separation agreement can be created indicating how the property is to be shared and also how issues involving children (such as custody) will be addressed. In a legal separation, individuals are still legally married but are able to live and run their households separately.
